The Way We Use Information
We use non-identifying and aggregate information to better design our Web site and gather information for product management and development at Mitchell 1. For example, we may tell our sales and marketing staff that X number of individuals visited a certain area on our Web site, or that Y number of software licenses were ordered during a particular time period, but we would not disclose anything that could be used to identify those individuals. This information may also be shared with Mitchell affiliates.
Finally, we will not use or share the personally-identifiable information provided to us online in ways unrelated to the ones described above without first providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.
Our Commitment to Data Security
We have put in place physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
When you place orders or access your account information, we offer the use of a secure server. The secure server software receives encrypted information through the Secure Sockets Layer (SSL) of your internet browser which encrypts the information you input before it is sent to us. Furthermore, we have taken appropriate safeguards to protect customer data against unauthorized access.
Our Commitment to Children's Privacy
Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our Web site from those we actually know are under 13, and no part of our Web site is structured to attract anyone under 13. Any parent or guardian that learns that their child may have submitted personally-identifiable information should contact us immediately at CustomerSupport@mitchell1.com.

Any controversy or dispute between you and MRIC concerning the Materials shall be submitted to final and binding arbitration as the sole and exclusive remedy for such controversy or dispute. Any claim shall be made by filing a demand for arbitration within one (1) year following the occurrence first giving rise to the claim. The right and duty of the parties to resolve disputes by arbitration shall be governed exclusively by the Federal Arbitration Act, and arbitration shall take place according to the Commercial Rules of the American Arbitration Association. Each party shall bear all of its own costs of arbitration, except that the fees of the arbitrator shall be divided equally between the parties. The arbitrator shall have no authority to amend or modify the terms of this Agreement or to award punitive or exemplary damages, and the award may be enforced by judgment. Before, during, or after arbitration each party shall have the right, without awaiting the outcome of the arbitration, to seek provisional remedies from an appropriate court including but not limited to temporary restraining orders or preliminary injunctions. Seeking any such remedies shall not be deemed a waiver of either party's right to compel arbitration.
No delay or omission by MRIC to exercise any right occurring upon any noncompliance on your part with respect to any of the terms of this agreement will impair any such right or power or be construed to be a waiver thereof. Any waiver by MRIC of any of the covenants, conditions or agreements to be performed by you will not be construed to be a waiver of any succeeding breach thereof or of any covenant, condition or agreement herein contained.
MODIFICATIONS TO TERMS AND CONDITIONS
